Data Protection Policy


1. Personal Obligation of the Operator


FC ONE works on the basis of mutual trust between the members and the platform. Protection of member's personal data therefore belongs to one of the most important principles which the operator feels obliged to fulfil. More of this in detail:
Personal data will only be used to enable access to the internet services requiring mandatory registration.
The personal data will never be given to a third party for advertising or marketing purposes.
FC ONE conforms with the strict data protection laws of Germany and the EU on the collection, processing and use of personal data.

INFORMATION for Minors:
FC ONE is mainly targeted at players, coaches, referees and football fans, boys or girls regardless, from the age of twelve (12) years and above. In addition the registration form presupposes that a certain maturity, and ability to foresee the consequences of the collection, processing and storage of personal data exists.
Therefore, membership for youths younger than 12 years old is excluded. In cases of doubt, the operator reserves the right to check the details of the age given and demand a written declaration or appropriate documents signed by the parents or guardians.



2. Legal Stipulations


The sensitive and responsible handling of the personal data of all members is a matter of extreme importance to FC ONE. All data protection laws and stipulations are closely complied with. The data protection laws above all include the Teleservice data protection laws (TDDSG), the National data protection laws (BDSG), the legal data privacy stipulations of the telecommunications law (§§ 85 ff. TKG) and the legislative guidlelines set at EU level. The following data protection policy informs how the protection and security of all personal data at FC ONE is guaranteed in line with the current and legally enforced stipulations.



3. Personal Data


3.1 Details required on registration
3.1.1 FC ONE is a sociable network. Like every network between people FC ONE is based on the principle that its members exchange relevant information with other members within a limited capacity. It is only in this way that FC ONE can function sensibly. This is why all members at the start, that is to say on registration, are requested to submit the following basic details about themselves:

First Name and Surname
Date of Birth
Country
Postcode, City
E-Mail Address
Password and Password-Repeat

3.1.2 From these details only specific details will be made accessible to other members, namely:

First name and Surname
Date of Birth
Sex
Country


The usual details, i.e. the member's email address and password naturally remain confidential, these are stored and coded and are only used to manage the membership profile by FC ONE.

3.2 Voluntary Information Beyond this each member has various possibilities to add more details to his profile voluntarily (e.g. Club, team, amongst others) or to publicise a photo. These details are not necessary but are useful in order to come into contact with other members. Every member decides independently and according to their own judgement which information s/he would like to share and which s/he would not like to share.

3.3 Private Domain Via the personal settings in the rubric 'Private Domain' there is an additional possibility to make specific information accessible only to defined persons or groups of, according to the member's own ideas.


4. Purpose


4.1 The collection, storage, processing and usage of the personal data gathered by FC ONE as mentioned in Point 1, conforms with the legal stipulations (especially §§ 3 ff. TDDSG and §§ 28, 29 BDSG).

4.2 The purpose of collection, saving, processing and usage of the data by FC ONE is solely to enable and maintain the social network made available to its members.

4.3 A purpose beyond promoting the structure of the FC ONE social network by collecting, saving, processing and using the data will not be expressly pursued. The data will not be employed for any other purposes.

4.4 FC ONE will offer members personalised advertising, if on registration the member has agreed to receive personalised advertising offers. The member can revoke his/her agreement to receive personalised advertising at any time in the future. The revocation can be declared in writing by a simple message (E-Mail, Fax, letter).


5. No data transfer to third parties


FC ONE does not give the personal data of its members to third parties unless the member has given his/her express permission, or if there is a compulsory obligation to do so by law. Where the member has consented, it can also be revoked for the future at any time with immediate effect by a simple message (E-Mail, Fax, letter).


6. Cookies


6.1 Cookies are small text files, which are stored temporarily in the memory or temporarily on the hard drive ("Session Cookie", "permanent Cookie" or "not permanent Cookie").These cookies delete by themselves after a certain amount of time, and pose no danger to the user's computer.

6.2 Every member has the choice to decide whether to accept cookies via the settings of the internet-browser-program: by selecting the option "to be informed about every cookie" or "to deny all cookies". FC ONE however advises that by denying a cookie it can restrict the usage of the FC ONE offer.


7. Data Security (Firewalls, Anti-virus technologies etc.)


The continually updated firewalls and security systems set up by FC ONE should protect the members as far as possible from viruses and unauthorised attacks from outside whilst using FC ONE. FC ONE commits to maintaining an adequate level of protection and to continually adapt the current standards in technological developments to the security technology used. At the same time members should be aware that due to the continuous emergence of new viruses and other means of attack on secured data systems offered by internet services, a hundred percent protection from attack cannot be guaranteed. FC ONE is not responsible for virus protection outside of the network. FC ONE is also not responsible for damage and destruction of data by unknown viruses. FC ONE will prosecute every discovered attack by a hacker according to civil and criminal law.


8. Information


Every member has the right to receive the personal information stored by FC ONE about each person free of charge. The request for information is to be addressed in writing to FC ONE. The request must be accompanied by a certified copy of an official and valid passport. The information will be sent by post to the member's address as given in the passport.


9. Correction, Deletion and Barring.


9.1 Where a member changes or corrects the details made by him/her and in the process deletes old entries, these former entries will be automatically and completely deleted. An official application to correct or delete is not necessary.

9.2 Irrespective of this, the member has the right to demand the correction fo non-applicable details which have been saved about him by FC ONE. Nevertheless, the simplest possibility is for the member to change his entries accordingly himself.

9.3 Where a member has irrevocably deleted his profile and thus his membership of FC ONE, all the details formerly entered by him in his profile will be automatically and completely deleted. A request to delete is not necessary.

9.4 Irrespective of this the member has the right to demand the deletion of all the personal data collected about him and which have been saved by FC ONE. However, the simplest possibility even in this case, is for the member to delete his entries himself.

9.5 Where the member demands the change, correction or deletion of his personal data, this can occur by e-mail, fax or letter. To match the details correctly the request must contain the following minimum details:

Surname, First name;
E-Mail;
Password;
Address;
Identification by passport copy (valid passport or personal identification card)


10. Implementation and adherence of the data protection policy


FC ONE commits to abide by the standards stated in this data protection policy and also in future to work at improving the data protection in the interests of its FC ONE members.


11. Changes to the data protection policy


As the offers of FC ONE are subject to change, in individual cases it can be necessary to make alterations to the data protection policy and information. The same applies to possible changes to the respective legal directives, which can require adjusting.
